City Council 6/24/08: added to the agenda

Klein said Majewski asked him to provide the acting city manager with items that she felt needed immediate consideration. Majewski agreed. Klein said it was up to the acting city manager to add items to the agenda under the rules of council, and asked Nevrus Nazarko if that was his wish.
Nazarko asked to put three items on the agenda, two resolutions and one ordinance. Klein moved to accept his recommendation and consider the items immediately. Gordon tried to make a point of order that the resolution was against the council rules, but Majewski took the vote anyway. Gordon tried again to raise a point of order, but was told that the resolution passed. Gordon asked to post an objection. She was ignored.

Klein offered a resolution to deny the appointment of Kirk and Huth as city attorney and reinstate Allen Brothers. Gordon said she had some questions. Klein said he has the right to speak both first and last on the issue, and that others on council can only speak to a subject twice under the council rules.
Gordon asked if the resolutions were an emergency because the council rules prohibit items submitted late to be considered except in cases of an emergency. Nazarko said it was. Gordon asked him to explain how it is an emergency. Nazarko said the city attorney was removed, and the new city manager doesn’t start until July 1. The city is involved in major litigation, and they needed to retain Allen Brothers. Gordon asked if it couldn’t wait 10 days. Nazarko said it couldn’t.
Majewski said the item under consideration was the appointment of the attorney and not how it was placed on the agenda. Gordon asked if Nazarko was part of the decision making process on the appointment. Nazarko said he wasn’t. Gordon asked if he felt pressured or threatened and if he made the decision of his own free will. Nazarko denied that he was pressured, and said the council hired a new city manager, and the charter allows the council to remove acting city managers at will.
Gordon said that this is very strange, disrespectful, and she is ashamed to be part of a group wanting to pass a development agreement so badly that they would dishonor a man that served them for three years. Klein tried to shout Gordon down. Majewski allowed her to continue.
Gordon said Crawford served them for three years, and Cooper and Nazarko should remember what happened on this day when it happens to them.
Robert Huth asked if he could speak. He said that he wanted to thank them for the appointment, should it be approved, and it had been a great five days serving the City of Hamtramck. His firm serves many municipalities and he has been a municipal attorney for a number of communities. He was interviewed for 3 hours, and would be glad to help the council. He appreciates them looking at his firm and giving them consideration.
Algazali said a house attorney was discussed. The way they are acting with two city managers and two attorneys makes them look bad. They are going too fast and should consider a house attorney.
Stackpoole was disappointed that the city manager fired Allen Brothers and asked why he didn’t allow the new city attorney to review the situation. It was done on a Friday afternoon and she is not happy with the situation.
Ahmed agreed with Stackpoole and claimed that Gordon had threatened Nazarko.
Majewski blamed Crawford for the situation and said the incoming city manager should decide. The situation is no reflection on Huth.
Klein said that Crawford had circumvented the city charter, if the process isn’t protected it is lost, and they council is protecting their rights.
Ahmed, Algazali, Klein, Shulgon, and Stackpoole denied Kirk and Huth’s appointment. Only Gordon voted to confirm it.
Algazali wanted to address comments by the public and pull items from the consent agenda. Majewski said there would be time for that later. Algazali wanted to offer condolences to Mrs. Smith on the loss of her husband. Majewski said this wasn’t the time because there was no motion on the floor.
Klein moved to revoke Nazarko’s appointment as acting city manager and appoint William Cooper as city manager. Algazali said that the attorney was supposed to draft a contract after the last meeting to have Crawford’s contract extended by two weeks, and the council hadn’t voted on that contract.
Gordon said the draft approved by the council for Cooper’s contract was not the same as the final draft she received last week. She asked who decided to have Cooper start on Monday when Crawford’s contract doesn’t end until July 1. She was not part of that decision making process, and asked who decided to pay two city manager’s for two weeks. Klein said it was an administrative decision and Crawford had decided to appoint an acting city manager. Gordon asked again who had made the decision to pay two city managers for two weeks. Majewski said she didn’t have an answer. Gordon said Cooper shouldn’t be paid for the time if they don’t know who authorized it.
Algazali said he voted against Cooper’s and Crawford’s contract because their salaries are too much. Cooper’s contract hasn’t been voted on.
Majewski said it makes perfect sense that Cooper should come in and learn his way around because Crawford had decided to take his last two weeks off. Cooper coming in shows his interest, initiative, and professionalism.
Klein said the idea that something is wrong with bringing Cooper in for the transition is shortsighted, and they are trying to make a seamless transition. (Gordon left the room.) Crawford is gone because he must use his vacation time or loose it. Klein disagreed that the contract was not approved and said it was signed. Algazali was not allowed to speak again.
Algazali voted against the resolution, and Gordon was not in the room. Klein, Stackpoole, Ahmed, and Shulgon voted for it, and the resolution passed.
A five minute recess was taken to administer the oath of office to William Cooper.
When the meeting reconvened, Majewski said there was one more emergency item to be discussed. Klein said it wasn’t an emergency and moved to consider it at the end of new business, seconded by Stackpoole. Some voted in favor of discussing the ordinance later, though no one was asked if they were opposed.
Algazali asked to remove a letter and the contract of the police chief from the consent agenda. Klein asked to remove a mowing contract and another letter.
Cooper said that not approving Huth’s firm puts the city in a tender situation, and asked that they consider reappointing Allen Brothers. He intends to make recommendations in 3 to 6 months on all appointed positions.
Algazali motioned to approve the appointment, seconded by Klein. Algazali said they wanted a house attorney. Majewski clarified that Algazali prefers it. Gordon said Allen Brothers contract had expired. Cooper recommended approving a contract for a maximum of 6 months. Gordon suggested 3 months. Algazali said he would accept the amendment. The appointment was approved.

    Mayor Jankowski vetoed Council’s resolution to limit the pay of the Allen Brothers, City Attorney. In his veto, Mayor Jankowski wrote that $4000 is insufficient for required legal services, and is less than the City is paying for the CEDD. Mayor Jankowski also wrote that department heads serve under the Mayor and receive their funding through the Budget Board and that Council’s discussion of setting low pay to force a resignation was against State law. Councilman Klein accused Mayor Jankowski of “telling lies” and read this article from The Detroit News about an investigation into illegal campaign donations from Allen Brothers PAC to Mayor Kwame Kilpatrick. He then went on to say that Mayor Jankowski is “using politics” to “get campaign funds”. Councilman Cedar said that the City Manager would be starting soon. Councilwoman Majewski pointed out that a contract had not been signed. Councilman Klein suggested that the City Manager should be the one to sign a contract. Councilman Cedar said they could always have a meeting to discuss pay with Allen Brothers later. Councilwoman Majewski was concerned that they may be impeding the Wayne County Jail PILOT lawsuit. All members voted for the resolution.
